These Terms & Conditions ("Terms") govern your use of Duara, the mobile application built and operated by Pluribus Tech Limited ("Duara," "we," "us," or "our"), a company incorporated in Kenya. By creating an account or using Duara, you agree to these Terms. If you don't agree, please don't use the app.
Duara is a coordination and record-keeping platform for chamas, family investment clubs, estate associations, and other community savings groups. It exists to give groups that already run on trust and shared rules a shared, tamper-evident record of those rules and the activity that flows from them — without taking over the group's money or its decisions.
On Duara, your group can:
Duara Records, an optional paid subscription, lets you export your group's financial history as a portable, verifiable record — useful, for example, when a member needs proof of savings history for another purpose.
You must be at least 18 years old and capable of forming a binding contract under Kenyan law to use Duara. When you register, you agree to provide accurate information and to keep it up to date.
You're responsible for keeping your account credentials secure and for all activity that happens under your account. If you suspect unauthorised access to your account, contact us immediately.
You may belong to more than one group on Duara. Each group operates independently, governed by its own constitution.
This is the most important section of these Terms, so we're stating it plainly: Duara is a coordination and record-keeping tool for your group's own money. It is not a bank, a savings and credit cooperative (SACCO), a payment service provider, or a custodian of funds.
Because Duara does not provide payment services, it operates outside the licensing regime administered by the Central Bank of Kenya under the National Payment System Act. If our service ever expands to include payment processing, we will update these Terms, notify you, and obtain any required regulatory authorisation before doing so.
Each group on Duara is governed by its own constitution — a set of rules your group writes, votes on, and can amend over time, subject to any cooldown periods and versioning rules built into the app. Duara enforces your constitution's rules at a technical level, for example by requiring the approval threshold your group has set before a loan or major decision takes effect.
Your constitution is an agreement between your group's members — it is not a contract with Duara, and Duara does not draft, review, or vouch for its legal adequacy or enforceability. If your group needs certainty on a legal point, we encourage you to seek independent legal advice.
When using Duara, you agree not to:
We may suspend or terminate accounts that violate this section, with notice where reasonably possible.
Duara generates documents based on what your group records in the app — including loan agreements, constitutions, meeting minutes, and financial reports — and cryptographically hashes each one at creation.
This hash proves a document has not been altered after it was generated. It does not, by itself, make the underlying document a legally binding or enforceable contract, and it does not independently verify the truth of the information members entered. Whether a Duara-generated document is legally binding depends on ordinary principles of Kenyan contract law — for instance, whether it genuinely reflects an agreement between the relevant parties. Duara does not provide legal advice. Groups handling significant sums, or facing a dispute about the validity of a document, should seek independent legal counsel.
Duara gives your group the tools to define its own rules, vote, and keep shared records — but we are not a party to any agreement between you and your group, and we do not mediate, adjudicate, or resolve disputes between members, including disagreements about whether a payment was made, whether a loan should be repaid, or how a constitution should be interpreted.
Where your group's constitution sets out its own dispute resolution process, we encourage you to use it. At our discretion, we may provide relevant records to help a dispute along, without taking a position on its merits.
Core group coordination features are free to use. Duara Records is an optional paid subscription for exporting your financial history.
Duara — including its name, branding, design, and underlying software — is owned by Pluribus Tech Limited and protected by applicable intellectual property law. These Terms don't grant you any rights to our trademarks, branding, or source code beyond what's needed to use the app as intended.
You retain ownership of the content you or your group submit to Duara — messages, documents, and records. By submitting it, you grant us a license to host, process, store, and display it as necessary to provide the service to you and your group.
You may delete your account at any time. This removes your personal profile data as described in our Privacy Policy; group financial records you were part of may persist as part of your group's audit trail.
We may suspend or terminate your access to Duara if you violate these Terms, or where we reasonably believe your account is being used for fraud or illegal activity. Where possible, we'll notify you and explain why.
A group itself can only be wound down through Duara's structured dissolution process, which follows your group's own constitution and requires the relevant member approvals — Duara does not unilaterally dissolve a group.
Duara is provided "as is" and "as available." We work hard to keep it reliable, but we don't guarantee that the app will be uninterrupted, error-free, or available at all times.
We don't guarantee the accuracy of information members enter, the creditworthiness of any member, the repayment of any loan, or the outcome of any group decision. Your group's financial and governance activity is your group's responsibility — Duara provides the tools, not the judgment calls.
To the maximum extent permitted by Kenyan law, Duara and Pluribus Tech Limited are not liable for indirect, incidental, or consequential damages arising from your use of the app, including financial losses arising from another member's actions, a disputed transaction, or a loan that isn't repaid.
You agree to indemnify and hold Pluribus Tech Limited harmless from any claim, loss, or expense (including reasonable legal fees) arising from your violation of these Terms, your misuse of the app, or a dispute between you and another member of your group.
We may update Duara's features and these Terms from time to time. When we make material changes to these Terms, we'll notify you in the app and update the "Last updated" date above. Continued use of Duara after a change takes effect means you accept the revised Terms.

These Terms are governed by the laws of Kenya. If a dispute arises between you and Duara, we'd rather resolve it directly — contact us first using the details below. If we can't resolve it that way, the courts of Kenya have exclusive jurisdiction over any dispute arising from these Terms or your use of Duara.
